Terms of Service
The purchase of any product or service through the Dylux website is governed by the following Terms of Use set forth by Dylux (“Terms of Use”). Please read these Terms of Use carefully. By accessing the Dylux website, you agree to be bound by them; if you do not agree, you may not access or use this site.
1. Acceptance of Terms of Use
By visiting, viewing, accessing, or using the Dylux website, including any services or information created, collected, compiled, or submitted to it, you agree to be bound by these Terms of Use, which constitute a legally binding agreement between you and Dylux. If you do not agree, you must not use the site or its services.
2. Provision of Services
You acknowledge that Dylux reserves the right to modify, improve, or discontinue any of its services at its sole discretion without notice, which may prevent you from accessing information on the Dylux website and providing services through subsidiaries or affiliates.
3. Proprietary Rights
You acknowledge and agree that the Dylux website may contain proprietary and confidential information, including trademarks, service marks, designs, and patents protected by intellectual property laws and international treaties. Dylux authorizes you to view and make a single copy of portions of its content for offline, personal, non-commercial use. Our content may not be sold, reproduced, or distributed without our written permission, which we may withhold at our sole discretion. Third-party trademarks, service marks, and logos are the property of their respective owners. All rights not expressly granted herein are reserved by Dylux.
4. Submitted Content
When you submit content to Dylux, you simultaneously grant Dylux an irrevocable, worldwide, royalty-free license to publish, display, modify, distribute, and syndicate your content. You confirm and warrant that you have the authority to grant this license to Dylux.
5. Termination of Terms of Use
These Terms of Use will remain in effect until terminated by Dylux at its sole discretion without notice. Provisions intended to survive termination will remain in effect.
6. Disclaimer of Warranties
You understand and agree that your use of the Dylux website is at your own risk and that our services are provided “AS IS” and “AS AVAILABLE.” Dylux makes no express or implied warranties, endorsements, or representations regarding the operation of the Dylux website and its information, content, materials, or products. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement, as well as warranties that access to or use of the service will be uninterrupted, error-free, or that defects will be corrected.
7. Limitation of Liability
You understand and agree that Dylux, its subsidiaries, and affiliates will not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information, or other intangible losses arising out of the use of or inability to use the service, information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information. This limitation applies whether or not Dylux has been advised of or should have been aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, Dylux’s liability is limited to the greatest extent allowed by law.
8. External Content
Dylux may link to third-party content, advertising, or websites, which it does not control or endorse. You acknowledge and agree that Dylux is not responsible for any advertising, products, or resources available from such sources.
9. Jurisdiction
You agree to submit to the personal and exclusive jurisdiction of the courts of California, USA, as determined by Dylux, to resolve any legal matter arising from these Terms of Use or your use of the Dylux website. If a court with jurisdiction rules that any provision of these Terms of Use is invalid, that provision will be removed, and the remaining terms will remain in full force and effect.
10. Entire Agreement
You understand and agree that these Terms of Use constitute the entire agreement between you and Dylux. You may be subject to additional terms and conditions when you use, purchase, or access other services, affiliate services, or third-party content or material.
11. Changes to the Terms of Use
Dylux reserves the right to modify these Terms of Use at its sole discretion without notice. Changes will become effective on the date they are posted on the Dylux website, and your continued use of the site after such changes signifies your agreement to be bound by the updated terms.
12. Disposal of Electrical Waste (WEEE)
Please do not dispose of old electrical waste with household waste, as it is unlikely to be recycled and may end up in landfills or incinerated. Dylux cooperates with authorized recycling organizations to ensure compliance with the Waste Electrical and Electronic Equipment (WEEE) Directive or related regulations. Customers are responsible for disposing of all Dylux products in compliance with applicable laws.
